1.1 For clarity throughout this document, the terms “Client”, “Buyer”, and “Customer” all refer to the individual or legal entity that purchases or contracts products or services from MOONCAKE Visuals.
1.2 These terms are used interchangeably to represent the party receiving and using our deliverables.
MOONCAKE Visuals provides high-quality digital products and creative services across virtual production, broadcast graphics, VFX, VR, AR, and real-time 3D environments. These include virtual sets, graphical packages, interactive elements, immersive environments, and consulting or technical support.
Deliverables are digital, and specifications will be stated clearly at purchase. The Client is responsible for confirming compatibility with their workflow and must have a foundational understanding of relevant software such as Unreal Engine. Support does not cover user error or lack of experience.
Support is limited to ensuring that files function as intended based on delivery specs. Technical issues must be verifiable and not caused by modifications, version mismatches, or misuse.
Clients must provide documentation (e.g. screenshots, recordings) when reporting issues. Issues caused by incorrect versions, altered files, or lack of knowledge are not covered under free support. These fall under custom technical services, billed separately.
Support is not training. A working knowledge of the tools is expected to get full value from our products.
Clients receive a non-exclusive, non-transferable license to use purchased assets in their own productions, including modification and use in commercial work within their infrastructure.
MOONCAKE Visuals retains ownership of all designs, including custom work, unless exclusivity is agreed in writing. Assets cannot be resold, redistributed, or shared outside the Client’s infrastructure.
Free assets may be used commercially but must not be redistributed. Credit must be given when used in public/client-facing projects.
4.X MOONCAKE Visuals retains full ownership of all creative assets, regardless of whether they are sold directly or through authorized affiliates or resellers. Any revenue shares or percentages distributed to partners are based on prior agreements and do not imply a transfer of ownership. For any customizations, technical support, or usage clarification, direct communication with the end Client is required unless otherwise agreed in writing. If an intermediary wishes to manage Client communications, this must be explicitly agreed upon beforehand with MOONCAKE Visuals.
Custom work requires a formal agreement outlining scope, pricing, ownership, and timeline. Unless explicitly stated, MOONCAKE Visuals retains ownership and may reuse or modify the work.
Deposits are non-refundable. Final deliverables follow the same license and support terms as standard products. Clients must provide clear input and timely feedback to ensure project success.
All sales are final. No refunds, returns, or exchanges are offered due to the nature of digital and custom services. Completion of payment and delivery finalizes the transaction.
Clients waive their right to dispute or charge back after purchase. Questions should be clarified before payment. Attempts to charge back without prior communication may result in legal action and revoked access.
All products and services are provided "as is" without warranty. MOONCAKE Visuals is not liable for direct or indirect damages arising from use or inability to use the products.
Clients are responsible for ensuring compatibility and appropriate implementation in their systems.
All designs, assets, and content remain the exclusive IP of MOONCAKE Visuals unless otherwise agreed in writing. Clients do not own the IP by default; only a license to use it as described is granted.
Unauthorized use, reproduction, or distribution is prohibited and may result in legal action.
MOONCAKE Visuals may update these terms at any time. Clients will be notified of major changes, and continued use implies acceptance. Clients should review terms regularly.
Clients may use assets in AI or ML projects as long as redistribution of source files does not occur. Use must follow existing licensing rules.
Client data is handled in compliance with privacy laws. It is used only for order processing, support, and communications. MOONCAKE Visuals does not sell or rent client data.
Clients may request access or deletion of their data via contact@mooncakevisuals.com.
